General Terms and Conditions (GTC)
of
Motos & Wonders KLG

1. Conclusion of Contract
A contract between the customer and Motos & Wonders KLG is concluded exclusively through written or electronic registration and the confirmation of the booking by Motos & Wonders.

2. Minimum Number of Participants
We reserve the right to cancel an event if the required minimum number of participants is not reached. In this case, participants will be informed without delay.
This applies up to one week before day tours with an event and up to three weeks before multi-day tours.
Custom tours will be carried out with a minimum of one participant.
Any payments already made will be fully refunded in the event of cancellation or, if requested, credited toward an alternative trip.

3. Prices and Price Changes
3.1 Day Tours
For last-minute bookings of a day tour without an event, payment can be made either at the time of booking or directly to the tour guide.
3.2 Multi-Day Tours with Overnight Stay
The tour price includes the services of the tour guide, overnight accommodation, and planned events. All other costs such as meals, fuel, or personal expenses are to be covered by the participant. The full amount is due at the time of booking.
3.3 Price Changes
Price changes may occur up to 20 days before the start of the trip if external costs (e.g. fuel surcharges, taxes, currency fluctuations) increase. Notification of a price change will be provided in writing or electronically by Motos & Wonders. If the increase exceeds 10% of the original tour price, the customer has the right to withdraw from the booking free of charge within five days of receiving the notice.

4. Cancellation Policy
In the event of cancellation by the customer, the following fees apply:
Up to 60 days before the start of the trip: free of charge
59 to 30 days before the start: 25% of the tour price
29 to 14 days before the start: 50% of the tour price
Less than 14 days before the start: 100% of the tour price
The customer may provide evidence that the actual costs incurred were lower than the stated cancellation fees and will then be reimbursed accordingly.
We strongly recommend taking out travel cancellation insurance.

5. Substitute Participant
It is possible to name a substitute participant, provided they meet the participation requirements. Any additional costs incurred will be passed on at cost.

6. Program Changes
Motos & Wonders reserves the right to adjust individual services before or during the trip, provided that the character of the tour is preserved (e.g. changes to accommodations or routes).
Significant changes that substantially affect the overall itinerary will be communicated to participants in advance. In such cases, we will endeavor to provide an appropriate solution.
A free cancellation is only possible if the changes represent a substantial deviation from the originally booked trip.

7. Liability and Disclaimer
Motos & Wonders accepts no liability for personal injury or property damage resulting from participation in the tour.
We strongly recommend taking out personal accident and liability insurance.
Each participant is fully responsible for their own riding behavior and must comply with applicable traffic regulations.
The liability of Motos & Wonders is limited to three times the tour price, unless the damage was caused by gross negligence or intent by Motos & Wonders.
7.1 Duties of Participants
Each participant must:
Hold a valid motorcycle license.
Ride a roadworthy and street-legal motorcycle.
Ride responsibly, even while following the tour guide’s instructions.
Be in good physical and mental condition.
Ride considerately and avoid roads beyond their ability.
Wear full, proper motorcycle protective gear (helmet, jacket, trousers, gloves, boots).
Comply with Swiss traffic regulations at all times.
Motos & Wonders does not provide any additional insurance coverage for participants. Statutory provisions regarding liability and vehicle insurance, as well as Swiss traffic law, apply.
7.2 Exclusion Criteria
A participant may be excluded from the tour if they:
Fail to wear proper protective gear
Ride a motorcycle that is not roadworthy
Do not hold a valid motorcycle license
Are under the influence of alcohol, drugs, or medication
Act recklessly or endanger others
Fail to follow the instructions of the tour guide
Exclusion is without entitlement to a refund of the tour price.

8. Exclusions of Liability
Motos & Wonders is not liable if non-performance or improper performance of the contract, or any damage, is due to:
The participant’s own fault
Unforeseeable or unavoidable shortcomings of a third party not involved in the contractual service
Force majeure or an event that Motos & Wonders, despite due diligence, could not foresee or prevent
Failure to follow the safety instructions of the tour guide
Violation of applicable Swiss traffic regulations
Events of force majeure include, in particular, natural disasters, pandemics, political unrest, or official orders.

9. Insurance
Insurance is the responsibility of participants.
For all motorized tours, liability insurance is mandatory.
We further recommend travel insurance, ETI coverage, comprehensive motorcycle insurance, roadside assistance, and SOS return travel insurance.

10. Data Protection & Image Rights
Photos and videos are regularly taken on our tours. Motos & Wonders may use these for promotional purposes on the website, social media, and other marketing materials. Use is automatic unless the participant explicitly objects in writing (opt-out).

11. Place of Jurisdiction
Swiss law applies exclusively. Place of jurisdiction is the registered office of the company.
For customers residing abroad, the mandatory provisions of the respective consumer protection law also apply.
