General Terms and Conditions (GTC)
of
Motos & Wonders KLG

1. Contract Conclusion & Scope of Application
A contract is concluded upon written or electronic booking and confirmation by Motos & Wonders KLG.
For multi-day tours including overnight accommodation, we act as a tour operator; the Swiss Federal Act on Package Travel (PRG) applies. Pre-contractual information (services, minimum number of participants, total price, payment conditions, as well as any passport, visa or vaccination requirements) forms an integral part of the contract.
 
2. Minimum Number of Participants & Cancellation by the Organizer
If the stated minimum number of participants is not reached, we reserve the right to cancel:
day tours with event: up to 1 week before the event
multi-day tours: up to 3 weeks before departure
Individual tours are conducted from one participant onwards.
Any payments already made will be fully refunded or, upon request, credited towards an alternative tour.
 
3. Prices, Payment & Price Changes
3.1 Day Tours
The tour price is due upon booking, at the latest before the start of the tour.
3.2 Multi-Day Tours with Overnight Accommodation
The tour price includes the services listed in the tour description (e.g. guide, accommodation, planned events). Not included are services not expressly listed, in particular meals, fuel and personal expenses.
A deposit of 20% is due upon booking. The remaining balance must be paid no later than 30 days before departure.
3.3 Price Changes
Price changes may occur due to:
changes in transport or fuel costs
changes in taxes or official charges
exchange rate fluctuations
Price adjustments will be communicated no later than 3 weeks before departure.
An increase of more than 10% constitutes a significant contractual change and entitles the participant to accept the change, withdraw from the contract free of charge, or accept an alternative tour. Price reductions will be passed on accordingly.
3.4 Payment Processing via Payment Service Provider
Payments are processed via the external payment service provider Stripe (Stripe Payments Europe Ltd. or Stripe, Inc.).
The data required for payment processing is transmitted directly to Stripe. Motos & Wonders does not have access to full payment details (e.g. credit card numbers).

4. Cancellation by the Participant
In case of cancellation, the following fees apply:
up to 60 days before departure: free of charge
59–30 days before departure: 25% of the tour price
29–14 days before departure: 50% of the tour price
less than 14 days before departure: 100% of the tour price
The participant may prove that the actual costs incurred are lower and is entitled to a corresponding refund.
We strongly recommend taking out travel cancellation insurance.
 
5. Substitute Participant (Assignment)
The booking may be transferred to a substitute participant up to 14 days before departure, provided the substitute fulfils all participation requirements.
Actual third-party costs plus a processing fee of CHF 30 will be charged.
 
6. Changes to Contract / Program
Motos & Wonders reserves the right to modify individual services before or during the tour, provided the overall character of the tour remains unchanged.
In the event of significant changes, participants will be informed promptly. Free withdrawal is only possible if the change represents a substantial deviation from the original booking.
 
7. Liability
Participation is at the participant’s own risk. Each participant is responsible for their own riding behaviour and compliance with traffic regulations.
Liability of Motos & Wonders is limited to twice the tour price, except in cases of intent or gross negligence.
 
8. Participation Requirements
Participants must:
hold a valid driving licence
ride a roadworthy, legally registered motorcycle
wear complete protective motorcycle gear
comply with traffic laws
ensure physical and mental fitness
Motos & Wonders does not provide additional insurance coverage for participants.
 
9. Exclusion from the Tour
Participants may be excluded if they endanger themselves or others, violate safety rules or fail to comply with the tour guide’s instructions.
No refund entitlement exists in such cases.
 
10. Force Majeure
Events beyond our control (e.g. natural disasters, pandemics, official orders) may lead to route changes or tour cancellation.
If a significant part of the tour cannot be carried out, an appropriate refund will be granted.
 
11. Insurance
Insurance coverage is the responsibility of the participants. We recommend comprehensive travel and breakdown insurance.
 
12. Defects, Remedies & Return Transport
Any defects must be reported immediately on site or via the 24/7 emergency contact.
If a significant part of the tour cannot be performed due to a defect or force majeure and the tour is terminated, Motos & Wonders will organise appropriate return transport for the participant in accordance with the PRG.
Return transport relates to the participant only; vehicle transport is not included unless explicitly agreed.

13. Protection of Customer Funds

Customer payments and return transport are secured in the event of insolvency or bankruptcy in accordance with the Swiss Package Travel Act (PRG), e.g. via the Swiss Travel Industry Guarantee Fund or an equivalent security. Proof can be provided upon request.
 
14. Data Protection & Image Rights
Personal data is processed in accordance with Swiss data protection law as outlined in our Privacy Policy.
Photos and videos taken during tours may be used for marketing purposes unless the participant expressly objects in writing.
 
15. Applicable Law & Jurisdiction
Swiss law applies exclusively. Place of jurisdiction is the registered office of the company.
 
16. Entry & Compliance
Participants are responsible for complying with entry, transit and customs regulations. We provide information to the best of our knowledge but accept no liability for denied entry.
