Terms and Conditions 

1. Conclusion of the Contract and Scope

A contract between the customer and Motos & Wonders KLG is formed upon written or electronic booking and its confirmation by Motos & Wonders KLG. Upon booking, the customer confirms that they have read and accepted the General Terms and Conditions. The version of the General Terms and Conditions published at the time of booking shall apply.

For multi-day tours involving overnight accommodation, Motos & Wonders KLG acts as a tour operator; the Federal Act on Package Tours (PRG) applies. Day trips without overnight accommodation do not constitute package tours within the meaning of the PRG.

The tour description on the website or in the offer from Motos & Wonders KLG constitutes the terms of the tour. In particular, it specifies the scope of services, prices per participant category, the deposit amount, the registration deadline, the minimum number of participants, the required driving licence category, and any tour-specific deviations from these General Terms and Conditions.

The pre-contractual information contained at the time of booking in the tour description, the booking confirmation or in individual agreements expressly confirmed in writing – in particular regarding services, the minimum number of participants, total price, payment terms and any entry, transit, visa, vaccination and participation requirements, shall form an integral part of the contract, unless expressly agreed otherwise. Details regarding guide allocation are for planning purposes only; we reserve the right to change the guide for good cause, in particular in the event of illness or accident, provided that a guide with equivalent qualifications takes over.

Motos & Wonders KLG is entitled to set a registration deadline for individual tours. The date specified in the relevant itinerary or booking confirmation shall be decisive. After the registration deadline has passed, bookings may be declined or accepted only upon express confirmation from Motos & Wonders KLG.

These Terms and Conditions are written in German. In the event of any discrepancies between language versions, the German version shall prevail.

2. Registration deadline, minimum number of participants and cancellation

The minimum number of participants specified in the relevant tour description or booking confirmation applies to the running of certain tours. If this number is not reached, Motos & Wonders KLG is entitled to cancel the tour. Motos & Wonders KLG may, at its own discretion, run a tour even with fewer participants.

The registration deadline stated in the relevant advertisement or booking confirmation is decisive for the final decision on whether the tour will go ahead. Up until this point, Motos & Wonders KLG may cancel the tour if the minimum number of participants is not reached. Motos & Wonders KLG will decide on whether the tour will go ahead by the registration deadline at the latest and will inform all registered participants in writing or electronically.

Flights, train tickets, accommodation before or after the tour and any other travel arrangements you make yourself (Clause 3.2) should only be booked once you have received confirmation that the tour will go ahead. Motos & Wonders KLG will not cover any costs in this regard, regardless of when they were booked – not even in the event of cancellation, postponement or alteration of the tour.

Notice of cancellation will be given in writing or electronically. Motos & Wonders KLG will inform the customer as soon as possible once it becomes apparent that the minimum number of participants is unlikely to be reached.

Unless expressly agreed otherwise, private tours will take place with a minimum of 1 participant.

In the event of cancellation by Motos & Wonders KLG, any payments already made will be refunded in full. The refund will be made within 14 days of notification of the cancellation to the original method of payment. The customer shall have no further claims provided that the cancellation is made in good time and is based on the agreed minimum number of participants. At the customer’s request, a rebooking or credit note for an alternative tour may be arranged in lieu of a refund.

3. Prices, Payment and Price Changes

3.1 Day trips

The full tour price is payable at the time of booking, unless otherwise stated in the tour description or booking confirmation.

The scope of services is set out in the tour description; fuel is not included. The minimum number of participants, registration deadline and cancellation policy are governed by clause 2.

Cancellation of day trips: Up to the registration deadline, the tour price will be refunded minus an administration fee of CHF 30; at the customer’s request, a fee-free rebooking to another day trip date may be arranged instead, subject to availability. After the registration deadline or in the event of a no-show, the full tour price is payable. A replacement participant (Clause 5) may be named free of charge up to the start of the tour.

3.2 Multi-day tours with overnight accommodation

The tour price includes the services expressly stated in the relevant itinerary or booking confirmation, in particular guide services, accommodation and scheduled programme items. If meals or fuel are specified as included in the itinerary, they form part of the tour price to the extent stated therein.

Services not expressly stated as included are not covered, in particular personal expenses, drinks outside the included meals, parking fees and individual additional services, unless these are expressly part of the booked package.

Flights, travel to and from the meeting point, and services before or after the tour are not included in the package. Any information provided by Motos & Wonders KLG in this regard constitutes non-binding recommendations.

The deposit specified in the tour description is due upon booking. The balance must be paid no later than 30 days before the start of the tour. If the booking is made less than 30 days before the start of the tour, the full tour price is due immediately.

Payment is made by card via Stripe or by bank transfer. The date on which payment is received by Motos & Wonders KLG is decisive.

If the balance is not received by the due date, Motos & Wonders KLG will issue a reminder with a grace period of 5 days. If this grace period expires without payment being made, Motos & Wonders KLG may withdraw from the contract and allocate the place to another party; the cancellation fees set out in clause 4 will be charged to the customer.

Any additional services booked or extras agreed at a later date may be invoiced separately and are payable in accordance with the deadlines stated in the booking confirmation.

If the customer does not make use of services included in the tour price, either in whole or in part, or if they voluntarily opt for a different, less extensive or cheaper service, there is generally no entitlement to a refund or partial refund, provided that the waiver is not due to circumstances for which Motos & Wonders KLG is responsible.

Insofar as, within the framework of a tour, certain additional services or included services are relevant or usable only for individual participants due to their individual travel arrangements, vehicle configuration, origin or pre-existing conditions, other participants shall have no entitlement to a substitute service, price reduction or partial refund.

3.3 Price changes

Price changes after the contract has been concluded are only permitted if they are attributable to changes in transport or fuel costs, changes in official levies or taxes, or exchange rate fluctuations, and these changes directly affect the specific tour price.

The customer shall be notified of any price change in writing or electronically no later than 3 weeks before the start of the tour. The notification shall state the reason for and the calculation of the adjustment.

If the price increase exceeds 10 per cent of the originally agreed tour price, this shall be deemed a material amendment to the contract. In this case, the customer is entitled to accept the amendment, withdraw from the contract free of charge, or choose an alternative tour offered.

Any price reductions will be passed on to the customer accordingly.

3.4 Payment processing via payment service providers

Depending on the chosen payment method, payment processing is carried out via the external payment service provider Stripe (Stripe Payments Europe Ltd. or Stripe, Inc.).

As part of the payment processing, the necessary payment and transaction data is transmitted directly to Stripe and processed there. Motos & Wonders KLG has no access to full payment details, in particular to full credit card details.

Stripe’s Terms of Service and Privacy Policy apply in addition to these provisions. Further information on data processing can be found in our Privacy Policy.

4. Cancellation by the customer

Withdrawal by the customer must be made in writing or in text form. It must be sent to team@motos-and-wonders.ch. The date on which Motos & Wonders KLG receives the notice of withdrawal is decisive for the calculation of cancellation fees.

In the event of cancellation by the customer, the following cancellation fees apply:

• up to 60 days before the start of the tour: an administration fee of CHF 30; the remainder of the payment made will be refunded
• 59 to 30 days before the start of the tour: the deposit paid as stated in the tour description
• 29 to 14 days before the start of the tour: 50 per cent of the tour price
• less than 14 days before the start of the tour: 100 per cent of the tour price

Substitutes as per clause 5 are permitted.

Cancellation fees will be offset against payments made. Any credit balance will be refunded within 14 days; any outstanding balance must be paid within 10 days.

Clause 3.1 applies to day tours. For partner tours (Clause 16), different cancellation fees may be specified in the tour description. The consequences of cancellation for the passenger are governed by Clause 6.

The customer reserves the right to prove that Motos & Wonders KLG has incurred no loss, or a loss substantially less than the flat-rate amounts specified above, as a result of the cancellation.

If the customer fails to arrive at the agreed meeting point, does not commence the tour, or is unable to take part due to a lack of personal requirements or necessary travel documents, this shall be deemed a cancellation on the day the tour begins.

In the event of cancellation or changes, the actual external costs incurred, as well as a reasonable compensation for expenses, may be charged for additional services and special services that have been booked individually, already procured or specifically arranged for the customer. This also applies in the event of a cancellation that would otherwise be free of charge, provided that the customer was expressly informed of this at the time of booking.

In the event of defects or tour cancellation, the rights to redress, price reduction and repatriation as set out in Clause 21 shall apply; there is no strict requirement for written notice of defects.

5. Substitute and Transfer of the Booking

The customer is entitled to name a substitute no later than 7 days before the start of the tour, provided that this is still feasible from an organisational and practical point of view. This is subject to the substitute meeting all the eligibility criteria for the booked tour.

Motos & Wonders KLG may refuse the transfer if the substitute does not meet the participation requirements or if there are legal, organisational, regulatory or service-related reasons preventing it, in particular in connection with accommodation, transport, partner services or other booked services.

The person who originally made the booking and the replacement participant are jointly and severally liable for the tour price and for all actual and verifiable additional costs incurred, in particular for rebooking, name change, hotel, transport or other additional costs.

For multi-day tours, Motos & Wonders KLG charges a processing fee of CHF 30 for the transfer; any actual additional costs incurred by third parties will be charged separately. For day tours, the transfer is possible up until the start of the tour and is free of charge.

6. Participant options and passengers

The tour description specifies the prices for riders in single rooms and for riders with a passenger in a twin room. If two riders wish to share a twin room, this will be arranged on an individual basis upon request.

The booking of a passenger is linked to the rider’s booking. If the rider cancels, the cancellation also applies to the passenger, unless the passenger participates with another rider. The cancellation fees set out in clause 4 apply to both bookings.

Passengers accept these General Terms and Conditions as participants. The conditions of participation (Clause 10) and the requirement to wear appropriate equipment apply mutatis mutandis. The rider is responsible for ensuring that their vehicle is authorised to carry passengers and that the passenger is suitably equipped.

7. Bookings on behalf of third parties

Anyone booking on behalf of other persons confirms that they are authorised to do so, shall pass these Terms and Conditions on to them, vouches for the accuracy of their details and is jointly and severally liable with them for the tour price and any cancellation fees.

8. Underage participants

Persons under the age of 18 may take part in tours that are expressly authorised for this purpose in the tour description. The booking must be made by a legal representative or with their written consent.

The legal representative confirms that they have taken note of the conditions of participation (clause 10), the rules set out in clauses 11 and 12, and the risks associated with motorcycling, and is liable for the tour price and cancellation fees. The guide’s authority to issue instructions (clauses 10 and 13) applies without restriction to underage participants.

9. Vouchers

Vouchers are valid until the date stated on the voucher, are transferable and may be redeemed for any tour, subject to availability. Cash redemption is not permitted; any unused balance remains as credit until the voucher’s expiry date.

In the event of cancellation of a tour paid for with a voucher, the cancellation fees in accordance with clause 4 will be offset against the voucher value; any remaining credit balance will be retained.

10. Participation requirements

Each participant is personally responsible for ensuring that they meet the personal, driving, health and legal requirements for taking part in the booked tour.

In particular, participants must:

• hold a valid driving licence required for the vehicle being used,
• meet the driving licence category and any minimum driving experience requirements specified in the tour description,
• use a vehicle that is authorised for use on public roads, roadworthy and in compliance with statutory regulations,
• be able to drive the vehicle they are using safely and under their own responsibility at all times,
• be physically and mentally capable of completing the booked tour safely, and must not be in any circumstances that would significantly impair their ability to participate safely,
• must declare any health conditions or medication that may affect their fitness to drive before the tour,
• realistically assess their riding abilities and inform Motos & Wonders KLG or the guide immediately if they do not feel capable of tackling a stage, route or riding situation,
• wear a full set of protective clothing, consisting of a helmet, motorbike jacket and trousers with protectors, gloves and ankle-high boots; for Vespa and scooter tours, the minimum equipment specified in the tour description applies,
• be considerate and not endanger either themselves or others,
• comply with the applicable traffic regulations and legal requirements at all times, and
• when travelling abroad, carry all necessary identity, driving, vehicle and insurance documents, as well as any other documents required by law.

Participants ride at their own risk at all times, even when following the guide’s advice, recommendations or instructions.

Motos & Wonders KLG or the relevant guide is entitled, where this appears necessary for safety reasons, in the event of recognisable overexertion, a lack of riding proficiency, inadequate equipment, an unsuitable vehicle or other safety-related concerns, to issue instructions, adjust the pace or route, order additional breaks, or exclude a participant, either wholly or in part, from further participation.

There is no entitlement to a specific route, stage or level of difficulty. Alternative sections may be offered to individual participants where the route, timetable and safety permit; the decision rests with the guide.

Any fines, charges, penalties or other disadvantages arising from breaches of statutory regulations or official orders shall be borne exclusively by the participant concerned.

11. Role of the guide and riding in a group

The guide leads the route and organises the itinerary. He is not a driving instructor, assumes no duty of supervision or care, and does not direct traffic; in particular, he does not secure junctions or road junctions for the group.

Hand signals, route indications and recommendations from the guide are intended as guidance. They are not riding instructions nor do they constitute authorisation for any manoeuvre, in particular not for overtaking manoeuvres.

Each participant decides for themselves on speed, line, distance and overtaking, even when the guide is riding ahead. There is no entitlement to visual contact with the guide, to riding in a column or to waiting at a specific location.

The safety briefing before each stage forms an integral part of the tour. Attendance is compulsory; anyone who misses it will set off after consulting the guide, or not at all.

For partner tours (clause 16), these rules apply mutatis mutandis to the partner’s guides.

12. Alcohol, drugs and medication

On riding days, a blood alcohol level of 0.0 per mille applies before and whilst riding. The consumption of alcohol in the evening is the participant’s own responsibility; they are personally responsible for ensuring they are fit to ride the following day. Any medication that may impair driving ability must be declared before the tour (Clause 10).

If there is reasonable suspicion that a participant is unfit to ride, the guide shall prohibit them from continuing the ride; Clause 13 applies.

13. Exclusion from participation

Motos & Wonders KLG or the relevant guide is entitled to exclude a participant, either wholly or in part, from further participation in the tour if there are justified concerns regarding safety, behaviour or suitability.

Exclusion is permitted in particular if the participant:

• is not wearing the correct protective clothing,
• does not hold a valid driving licence required for the vehicle being used,
• uses a vehicle that is not roadworthy, unsuitable or does not comply with the law,
• is under the influence of alcohol, drugs or medication, or is otherwise unfit to drive, or breaches the rules set out in clause 12,
• endangers themselves or others,
• fails to follow instructions, safety guidelines or reasonable organisational requirements issued by Motos & Wonders KLG or the guide,
• obviously overestimates their driving ability or is clearly unable to meet the demands of the tour,
• or if other circumstances exist which make continued participation appear unsafe.

In the event of imminent danger, exclusion may take place immediately. Exclusion may apply to individual stages, sections of the route or the entire remainder of the tour.

The participant will be notified of the exclusion, stating the time, place and reason, and this will be documented by Motos & Wonders KLG.

If a participant is excluded for a reason for which they are responsible, there is no entitlement to a refund of amounts already paid or to compensation for services not received; no pro-rata settlement will be made for individual services such as meals, fuel or guiding. Only accommodation that Motos & Wonders KLG is able to cancel free of charge with the service provider following the exclusion will be refunded, less an administration fee of CHF 30. Any further costs arising from the exclusion shall be borne by the excluded participant.

14. Changes to the contract and programme

Motos & Wonders KLG reserves the right to adjust individual services or programme items before or during the tour, provided that the overall nature of the booked tour is maintained and the change is objectively justified and reasonable for the customer. This applies in particular to changes to routes, accommodation, stages or individual programme items due to safety reasons, weather conditions, road or traffic conditions, official requirements, local circumstances or the availability of service providers.

Significant changes to the agreed services will be communicated to the customer immediately in writing or electronically. Significant changes are, in particular, those that substantially affect the overall nature of the booked tour, as well as price increases of more than 10 per cent of the agreed tour price. The following, in particular, are not considered material changes: a change of guide for good cause; a change of individual accommodation to equivalent establishments; adjustments to individual stages due to road conditions, weather or safety; and, in the case of partner tours, a change of the motorbike model provided by the partner to an equivalent model.

In the event of a material change, the customer is entitled to accept the change, withdraw from the contract free of charge, or choose an alternative tour offered by Motos & Wonders KLG.

During the tour, Motos & Wonders KLG or the relevant guide is the direct point of contact for organisational matters, reports of defects and emergencies.

15. Force majeure and extraordinary circumstances

If a tour cannot be carried out, cannot be carried out as planned, or can only be carried out with significant changes as a result of force majeure or other extraordinary, unavoidable circumstances beyond the control of Motos & Wonders KLG, Motos & Wonders KLG is entitled to adapt, reroute, postpone, partially cancel or cancel the tour entirely.

Such circumstances include, in particular, insofar as they are beyond the control of Motos & Wonders KLG, natural disasters, extreme weather and road conditions, official orders, border closures, political unrest, security situations, pandemics, strikes, road closures or other events that significantly impede or render impossible the safe or proper conduct of the tour.

In such cases, Motos & Wonders KLG shall take organisational measures appropriate to the specific circumstances. These include, in particular, changes to the route, stages, meeting points, accommodation or individual programme items.

Where required by law, any essential services not provided will be refunded or otherwise appropriately compensated. Any further claims for damages are excluded, provided that Motos & Wonders KLG is not at fault.

Motos & Wonders KLG shall assist participants, within reasonable limits, with organisational matters relating to the continued running, interruption or termination of the tour.

16. Partner Tours

Tours designated as ‘partner tours’ in the itinerary are organised by Motos & Wonders KLG in collaboration with a local partner. Motos & Wonders KLG is the organiser and the customer’s contractual partner. Guiding, vehicles, accommodation and the on-site programme are provided by the partner as the service provider; the partner’s guides are deemed to be guides within the meaning of these General Terms and Conditions. Motos & Wonders KLG accompanies the group with a contact person.

The use of a motorbike provided by the partner requires a hire agreement to be concluded on site with the partner. Deposits, excesses, insurance cover and the settlement of claims for damage to the vehicle are governed exclusively by this hire agreement and do not form part of the services provided by Motos & Wonders KLG (Clause 18).

Flights, travel to and from the destination are not part of the service; the note in Clause 2 regarding the booking of your own travel arrangements applies in particular to partner tours. For partner tours, the tour description may specify different deposit amounts and cancellation fees, as well as an earlier registration deadline.

17. Liability

Motos & Wonders KLG is liable for the proper performance of the contract within the framework of the applicable statutory provisions.

Motos & Wonders KLG’s liability shall be excluded or reduced to the extent that the non-performance, improper performance or damage is attributable to:

• an act or omission on the part of the customer,
• the act or omission of a third party who is not involved in the provision of the contractually agreed services and which Motos & Wonders KLG could not have foreseen or averted despite exercising due care, or
• force majeure or an event which Motos & Wonders KLG could not have foreseen or averted despite exercising due care.

Participants take part in the tour using their own vehicle or a vehicle provided by them, and do so at their own risk whilst driving. They remain responsible at all times for their driving style, speed, following distance, choice of route, braking behaviour, compliance with applicable traffic regulations and the safe operation of the vehicle they are using. Any advice, instructions or recommendations provided by Motos & Wonders KLG or the guide do not relieve participants of their own responsibility.

Motos & Wonders KLG’s liability is excluded or reduced, in particular, if the damage results from the customer overestimating their driving ability, fails to observe safety instructions, misjudges road, visibility, weather or traffic conditions, fails to maintain a safe distance from the vehicle in front, or operates the vehicle in an improper manner. Any contributory negligence on the part of the customer will be taken into account.

Damage caused by participants to one another must be settled between the parties concerned and their insurance companies; Motos & Wonders KLG accepts no liability for this.

Motos & Wonders KLG accepts no liability for items carried, luggage and valuables, or for vehicles parked in hotel car parks or other parking facilities.

There is no contractual limitation of liability for personal injury. For other types of damage, Motos & Wonders KLG’s liability is limited, to the extent permitted by law, to twice the agreed tour price, provided that the damage was not caused intentionally or through gross negligence. Mandatory statutory provisions and applicable international conventions remain reserved.

Claims arising from the contract are to be directed against Motos & Wonders KLG.

18. Arrangement of third-party services

Services included in the tour price, in particular accommodation, meals, guiding and programme items as set out in the itinerary, are services provided directly by Motos & Wonders KLG, even if they are carried out by partners or service providers. Only services expressly designated as third-party services in the itinerary or booking confirmation are deemed to be arranged by Motos & Wonders KLG, in particular hire agreements for motorbikes, vehicle transport and optional additional excursions. For such arranged services, the contract is concluded exclusively between the customer and the respective third-party provider.

In such cases, Motos & Wonders KLG is not the provider or lessor of the arranged third-party service. The content, availability, condition, suitability, insurance, deposit, excess, handover, return and proper provision of such third-party services are governed exclusively by the terms and conditions of the respective third-party provider.

Claims arising from or in connection with such arranged third-party services must be made by the customer directly against the relevant third-party provider.

In such cases, Motos & Wonders KLG is liable only for the proper arrangement of the service, but not for the provision of the third-party service itself.

If a hire vehicle or other third-party service is not merely arranged but is expressly offered and confirmed as an integral part of the tour service owed by Motos & Wonders KLG, the relevant services shall be deemed to form part of the scope of the contract.

19. Vehicles, Breakdowns, Faults and Return Transport

Each participant is personally responsible for the technical condition, operational and road safety, the legally required registration, insurance and suitability for the tour of the vehicle they are using.

In the event of a breakdown, fault, accident, damage, failure or loss of the vehicle used by the customer, the customer is, in principle, personally responsible for towing, repairs, alternative transport, storage of the vehicle, return transport of the vehicle, and for their own onward or return journey.

In such cases, Motos & Wonders KLG will, within reasonable limits, assist the participant in organising appropriate measures, in particular by contacting breakdown services, garages, rental companies, transport firms, accommodation providers or insurance companies. Motos & Wonders KLG is under no obligation to cover the costs in such cases, provided that the cause is not attributable to a service for which Motos & Wonders KLG is responsible or to conduct for which Motos & Wonders KLG is liable.

The guide is responsible for the group. In the event of a breakdown or accident involving an individual participant, the guide shall provide initial assistance and help organise breakdown services and accommodation; the group shall then continue the tour. There is no entitlement to be accompanied by the guide or to have the group wait.

If a participant leaves the tour early, they must notify the guide. From that point onwards, Motos & Wonders KLG’s obligation to provide services to that participant ceases.

Where rental vehicles, vehicle transport or other vehicle-related services from third-party providers are merely arranged, the contractual, usage, insurance and liability terms and conditions of the respective third-party provider shall apply exclusively. Claims arising from or in connection with such services must be made directly against the respective third-party provider.

If a hire vehicle, vehicle transport or any other vehicle-related service is not merely arranged but is expressly offered and confirmed by Motos & Wonders KLG as an integral part of the booked tour service, these services shall be deemed to form part of the scope of the contract.

20. Insurance

It is the responsibility of the participants to take out and maintain insurance cover that is both legally required and appropriate for the booked tour. Motos & Wonders KLG does not provide any additional personal, vehicle, travel, accident, breakdown, comprehensive, repatriation or return journey insurance for participants, unless expressly agreed otherwise in writing.

Each participant is personally responsible for ensuring that the vehicle they use has all the insurance, registrations and authorisations required by law and that these remain valid throughout the entire tour.

Participation is conditional upon holding valid motor vehicle third-party liability insurance with cover in all countries visited, accident or health insurance with cover abroad, and breakdown and repatriation cover with cover abroad. Proof of this must be provided on request before the start of the tour.

When using a hire vehicle, insurance cover, excess, deposit, scope of cover and claims settlement are governed exclusively by the contractual and insurance terms and conditions of the respective hire company or third-party provider. For partner tours where a motorbike is provided, clause 16 applies.

In the case of transport services arranged by us, in particular vehicle transport, the terms and conditions of the respective transport provider or third-party provider apply exclusively with regard to insurance, liability and claims settlement.

Motos & Wonders KLG also recommends taking out appropriate insurance and assistance cover, in particular for:

• travel cancellation,
• tour interruption and return journey,
• medical expenses and consequences of accidents,
• as well as, depending on the tour package, vehicle damage, theft, return transport of the vehicle and excess risks for hire vehicles.

It is the sole responsibility of the participant to check whether existing insurance cover is sufficient for the booked tour, the vehicle used, the destination country and the specific use of the vehicle.

21. Defects, Remedies and Return

Any defects or complaints relating to the tour must be reported immediately upon discovery to Motos & Wonders KLG or the relevant guide whilst on site. There is no strict requirement for written notification of defects. In the case of partner tours, defects must be reported to the partner’s guide and the Motos & Wonders KLG representative.

If a defect is not reported immediately on site, even though this would have been reasonable, any claim for a price reduction shall lapse, provided that Motos & Wonders KLG could have remedied the situation had the defect been reported in good time. Complaints after the end of the tour must be submitted in writing within 30 days.

Motos & Wonders KLG shall endeavour, within reasonable limits, to provide appropriate redress. This may take the form, in particular, of rectifying the defect, making a reasonable adjustment to the programme, providing an equivalent substitute service or, where objectively justified, granting an appropriate price reduction.

If, as a result of a significant defect or due to force majeure, a substantial part of the booked tour cannot be provided in accordance with the contract and the tour is therefore cancelled, Motos & Wonders KLG shall organise the participant’s return in a manner that is objectively and organisationally appropriate, in accordance with the applicable legal provisions.

The repatriation applies exclusively to the participant as a person. Costs and arrangements relating to towing, repairs, accommodation, return transport or the repatriation of vehicles are not covered by this obligation, unless such a service is expressly included as part of the booked tour package.

Any further claims shall only arise within the framework of the applicable statutory provisions.

22. Data Protection, Image Rights and Personal Photographs

Motos & Wonders KLG processes personal data in connection with the performance of the contract, the organisation of the tour and customer communications in accordance with the applicable privacy policy.

During the tour, photographs and video recordings may be taken for communication, documentation and marketing purposes. Recordings of the tour form part of the service and will be made available to participants after the tour for private use; any commercial use by participants requires the consent of Motos & Wonders KLG. Motos & Wonders KLG may use such recordings provided that the individuals concerned do not object either beforehand or afterwards.

This applies in particular to group photographs, atmospheric shots and general impressions of the tour.

In the case of recordings in which individual persons are specifically highlighted, portrayed or used in a clearly identifiable manner for marketing purposes, Motos & Wonders KLG will, as a matter of principle, seek separate consent.

An objection to further use may be raised at any time with effect for the future. The objection must be sent in writing or in text form to team@motos-and-wonders.ch. However, any publications or uses that have already taken place can only be reversed to the extent that this is reasonable and actually possible for Motos & Wonders KLG.

Participants may record the tour for private use, in particular as photographs, videos or GPS recordings. The sharing or publication of route data – GPS recordings, GPX files, detailed route descriptions – is not permitted; the routes are the work of Motos & Wonders KLG. Recordings in which other participants or guides are recognisable may only be published with their consent. Any commercial use of recordings of the tour, including on monetised channels, requires the written consent of Motos & Wonders KLG.

Filming must not compromise safe riding. The guide may prohibit filming whilst riding in certain situations.

In addition, the current privacy policy of Motos & Wonders KLG applies.

23. Entry, Transit and Compliance Information

Each participant is personally responsible for ensuring that they meet all entry, transit, residence, guide, vehicle, insurance and other legal requirements necessary for the booked tour and the countries visited or transited through.

This applies in particular to:

• valid identity and travel documents,
• required visas or entry permits,
• valid driving licences held by the participant,
• statutory vehicle and insurance documents,
• as well as compliance with customs, traffic, safety and other regulatory requirements.

Motos & Wonders KLG may, to the best of its knowledge, draw attention to known general requirements for the tour in question. However, it is the sole responsibility of the participant to verify their personal eligibility and to ensure the procurement and validity of all necessary documents and evidence.

If a participant is unable to commence the tour, continue the tour or enter a country as a result of missing, invalid or insufficient documents, permits or legal requirements, this shall be deemed a circumstance for which they are responsible. In such cases, there is no entitlement to a refund, unless otherwise provided for by law.

Any additional costs, fines, fees, return travel, return transport, rebooking or assistance costs arising from failure to comply with such regulations shall be borne by the participant concerned.

24. Governing Law and Jurisdiction

Swiss law shall apply.

Mandatory statutory provisions, in particular mandatory consumer protection regulations at the participant’s place of residence, remain reserved.

To the extent permitted by law, the place of jurisdiction shall be the registered office of Motos & Wonders KLG.

25. Final Provisions

Should any provision of these General Terms and Conditions be wholly or partially invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a valid provision that most closely approximates the economic purpose of the invalid provision.

Motos & Wonders KLG may amend these Terms and Conditions for future bookings. For existing bookings, the version published at the time of booking shall apply.
