General Terms and Conditions (GTC)
of
Motos & Wonders KLG
1. Conclusion of Contract and Scope
A contract between the customer and Motos & Wonders KLG is concluded upon the customer’s written or electronic booking and its confirmation by Motos & Wonders KLG.
For multi-day tours including overnight stays, Motos & Wonders KLG acts as the tour operator; the Swiss Federal Act on Package Travel (PRG) applies.
The pre-contractual information contained at the time of booking in the tour description, the booking confirmation, or in expressly confirmed written individual agreements, in particular regarding the services, minimum number of participants, total price, payment terms, and any entry, transit, visa, vaccination, or participation requirements, shall form part of the contract unless expressly agreed otherwise.
Motos & Wonders KLG is entitled to set a registration deadline for individual tours. The relevant deadline shall be the one stated in the respective tour description or booking confirmation. After expiry of the registration deadline, bookings may be declined or accepted only upon the express confirmation of Motos & Wonders KLG.
2. Registration Deadline, Minimum Number of Participants and Cancellation
Certain tours are subject to the minimum number of participants stated in the respective tour description or booking confirmation. If this minimum number is not reached, Motos & Wonders KLG shall be entitled to cancel the tour.
The relevant deadline for the final decision on whether the tour will take place shall be the registration deadline stated in the respective tour description or booking confirmation. Up to that time, Motos & Wonders KLG may cancel the tour if the minimum number of participants has not been reached.
Notice of cancellation shall be given in writing or electronically. Motos & Wonders KLG shall inform the customer as early as possible once it becomes apparent that the minimum number of participants is unlikely to be reached.
Unless expressly agreed otherwise, private tours shall be operated from 1 participant onwards.
In the event of cancellation by Motos & Wonders KLG, any payments already made shall be refunded in full. The customer shall have no further claims, provided the cancellation was made in due time and on the basis of the agreed minimum number of participants. At the customer’s request, a rebooking or a credit for an alternative tour may be agreed instead of a refund.
3. Prices, Payment and Price Changes
3.1 Day Tours
The full tour price is due upon booking unless otherwise stated in the tour description or booking confirmation.
3.2 Multi-Day Tours with Overnight Stay
The tour price includes the services expressly stated in the respective tour description or booking confirmation, in particular guiding services, accommodation, and planned programme items.
Services not expressly designated as included are excluded, in particular meals, fuel, toll charges, personal expenses, and individual additional services, unless these are expressly stated to form part of the booked offer.
A deposit of 20% of the tour price is due upon booking. The remaining balance must be paid no later than 30 days before the start of the tour. If the booking is made less than 30 days before the start of the tour, the full tour price shall be due immediately.
Booked additional services or extras agreed at a later date may be invoiced separately and are payable in accordance with the deadlines stated in the booking confirmation.
If the customer does not make use of services included in the tour price, in whole or in part, or voluntarily chooses a different, lesser, or cheaper service, there shall generally be no entitlement to a refund or partial refund unless the non-use is attributable to circumstances for which Motos & Wonders KLG is responsible.
Where certain additional or included services within a tour are only relevant or usable for individual participants due to their individual travel arrangements, vehicle configuration, origin, or pre-existing circumstances, other participants shall have no claim to substitute services, price reductions, or partial refunds.
3.3 Price Changes
Price changes after conclusion of the contract shall only be permitted where they result from changes in transport or fuel costs, changes in official charges or taxes, or exchange-rate fluctuations, and where such changes directly affect the specific tour price.
Any price change shall be notified to the customer in writing or electronically no later than 3 weeks before the start of the tour.
If the price increase exceeds 10% of the originally agreed tour price, this shall be deemed a material change to the contract. In that case, the customer shall be entitled to accept the change, withdraw from the contract free of charge, or choose an alternative tour offered.
Any price reductions shall be passed on to the customer accordingly.
3.4 Payment Processing via Payment Service Provider
Depending on the selected method of payment, payment processing is carried out via the external payment service provider Stripe (Stripe Payments Europe Ltd. and/or Stripe, Inc.).
For the purposes of payment processing, the payment and transaction data required for this purpose are transmitted directly to Stripe and processed there. Motos & Wonders KLG does not have access to full payment data, in particular not to complete credit card details.
Stripe’s terms of use and privacy provisions shall apply in addition. Further information on data processing can be found in our privacy policy.
4. Cancellation by the Customer
Any cancellation by the customer must be made in writing or in text form. The relevant date for calculating cancellation charges shall be the date on which the notice of cancellation is received by Motos & Wonders KLG.
In the event of cancellation by the customer, the following cancellation charges shall apply:
up to 60 days before the start of the tour: free of charge
59 to 30 days before the start of the tour: 25% of the tour price
29 to 14 days before the start of the tour: 50% of the tour price
less than 14 days before the start of the tour: 100% of the tour price
Substitute participants pursuant to Clause 5 are permitted.
The customer reserves the right to prove that Motos & Wonders KLG incurred no loss, or a substantially lower loss, than the flat-rate cancellation charges specified above.
If the customer does not appear at the agreed meeting point, does not commence the tour, or is unable to participate due to missing personal requirements or required travel documents, this shall be treated as cancellation on the day the tour begins.
For individually booked additional services, services already procured, or special services specifically arranged for the customer, the actual third-party costs incurred, together with a reasonable handling fee, may be charged in the event of cancellation or amendment. This shall also apply in cases of otherwise free cancellation, provided this was expressly communicated to the customer at the time of booking.
In the event of defects or interruption of the tour, the rights to remedy, price reduction, and repatriation under Clause 14 shall apply; notices of defects are not subject to any strict written-form requirement.
5. Substitute Participant / Transfer of Booking
The customer is entitled to nominate a substitute participant within a reasonable period before the start of the tour, provided that organisational and practical implementation remains possible. The substitute participant must fulfil all participation requirements applicable to the booked tour.
Motos & Wonders KLG may refuse the transfer if the substitute participant does not fulfil the participation requirements or if legal, organisational, regulatory, or service-related reasons prevent the transfer, in particular in connection with accommodation, transport, partner services, or other booked services.
The original booking customer and the substitute participant shall be jointly and severally liable for the tour price and for all actual and verifiable additional costs incurred, in particular rebooking fees, name change fees, hotel costs, transport costs, or other additional charges.
6. Participation Requirements
Each participant is personally responsible for ensuring that they meet the personal, riding, health-related, and legal requirements for participation in the booked tour.
Participants must in particular:
hold a valid driving licence required for the vehicle used,
use a vehicle that is approved for public road use, roadworthy, and compliant with legal requirements,
be able at all times to operate the vehicle they use safely and on their own responsibility,
be physically and mentally fit to complete the booked tour safely and must not be under circumstances that significantly impair safe participation,
assess their riding abilities realistically and inform Motos & Wonders KLG or the guide without delay if they feel unable to cope with a stage, route, or riding situation,
wear complete and proper protective clothing where required for the vehicle used and the type of tour,
behave considerately and not endanger themselves or others,
comply at all times with applicable traffic rules and legal requirements, and
carry all identity, driving, vehicle, and insurance documents, as well as any other legally required documents, necessary for international travel.
Participants always ride under their own responsibility, even when following the guide’s directions, recommendations, or instructions.
Where necessary for safety reasons, in particular in cases of apparent overstrain, insufficient riding safety, inadequate equipment, unsuitable vehicle, or other safety-related concerns, Motos & Wonders KLG or the respective guide shall be entitled to issue instructions, adjust the speed or route, order additional breaks, or exclude a participant in whole or in part from further participation.
There shall be no entitlement to the tour being conducted on a specific route, stage, in a specific riding style, or at a specific level of difficulty.
Fines, charges, penalties, or other disadvantages arising from violations of legal provisions or official orders shall be borne exclusively by the respective participant.
7. Exclusion from Participation
Motos & Wonders KLG or the respective guide shall be entitled to exclude a participant, in whole or in part, from further participation in the tour if there are justified concerns relating to safety, conduct, or suitability.
Exclusion shall in particular be permissible if the participant:
does not wear proper protective clothing,
does not hold a valid driving licence required for the vehicle used,
uses a vehicle that is not roadworthy, unsuitable, or not compliant with legal requirements,
is under the influence of alcohol, drugs, medication, or is otherwise unfit to ride,
endangers themselves or others,
fails to comply with instructions, safety rules, or reasonable organisational requirements of Motos & Wonders KLG or the guide,
clearly overestimates their riding abilities or is evidently unable to meet the demands of the tour,
or if other circumstances exist that make safe continued participation unreasonable.
In urgent cases, exclusion may take effect immediately. The exclusion may relate to individual stages, sections of route, or the remainder of the tour as a whole.
If a participant is excluded for a safety-related reason for which they are responsible, there shall be no entitlement to any refund of amounts already paid or to compensation for unused services. Any further costs arising from the exclusion shall be borne by the excluded participant.
8. Changes to Contract and Programme
Motos & Wonders KLG reserves the right to adjust individual services or programme items before or during the tour, provided that the overall character of the booked tour is preserved and the change is objectively justified and reasonable for the customer. This applies in particular to changes to routes, accommodation, stages, or individual programme items due to safety reasons, weather conditions, road or traffic conditions, regulatory requirements, local circumstances, or the availability of service providers.
Material changes to the agreed services shall be communicated to the customer without undue delay in writing or electronically. Material changes shall include, in particular, those that significantly affect the overall character of the booked tour, as well as price increases of more than 10% of the agreed tour price.
In the event of a material change, the customer shall be entitled to accept the change, withdraw from the contract free of charge, or choose a substitute tour offered by Motos & Wonders KLG.
During the tour, Motos & Wonders KLG or the respective guide shall be the direct point of contact for organisational matters, notices of defects, and emergencies.
9. Force Majeure and Extraordinary Circumstances
If a tour cannot be carried out, cannot be carried out as planned, or can only be carried out with significant changes due to force majeure or other extraordinary, unavoidable circumstances beyond the control of Motos & Wonders KLG, Motos & Wonders KLG shall be entitled to adapt, reroute, postpone, partially interrupt, or cancel the tour in whole or in part.
Such circumstances include, in particular, to the extent beyond the control of Motos & Wonders KLG, natural events, extreme weather and road conditions, official orders, border closures, political unrest, security situations, pandemics, strikes, closures, or other events that substantially hinder or prevent the safe or proper operation of the tour.
In such cases, Motos & Wonders KLG shall take such organisational measures as are appropriate under the circumstances. This includes, in particular, changes to the route, stages, meeting points, accommodation, or individual programme items.
To the extent required by law, essential services not provided shall be refunded or otherwise compensated appropriately. Any further claim for damages shall be excluded insofar as Motos & Wonders KLG is not at fault.
Motos & Wonders KLG shall support participants, within reasonable limits, with organisational matters relating to the continuation, interruption, or termination of the tour.
10. Liability
Motos & Wonders KLG shall be liable for proper performance of the contract within the scope of the applicable legal provisions.
The liability of Motos & Wonders KLG shall be excluded or reduced to the extent that the non-performance, improper performance, or damage is attributable to:
an act or omission of the customer,
an act or omission of a third party not involved in the contractually agreed provision of services and which could not have been foreseen or avoided by Motos & Wonders KLG despite exercising due care, or
force majeure or an event that Motos & Wonders KLG could not have foreseen or avoided despite exercising due care.
Participants take part in the tour with their own vehicle or a vehicle used by them and under their own riding responsibility.
They remain solely responsible at all times for their riding style, speed, distance, line choice, braking behaviour, compliance with applicable traffic rules, and the safe operation of the vehicle used by them. Directions, instructions, or recommendations given by Motos & Wonders KLG or the guide do not release participants from their own responsibility.
The liability of Motos & Wonders KLG shall in particular be excluded or reduced where the damage is caused by the customer overestimating their riding ability, failing to follow safety instructions, misjudging road, visibility, weather, or traffic conditions, failing to keep a safe distance from the vehicle ahead, or improperly operating the vehicle used. Any contributory negligence of the customer shall be taken into account.
There shall be no contractual limitation of liability for personal injury. For other damage, the liability of Motos & Wonders KLG shall, to the extent permitted by law, be limited to twice the agreed tour price, unless the damage was caused intentionally or by gross negligence. Mandatory statutory provisions and applicable international conventions remain reserved.
11. Arranged Third-Party Services
Where Motos & Wonders KLG merely arranges third-party services, in particular rental vehicles, accommodation, transfers, events, admissions, or other additional services, the contract for such service shall be concluded exclusively between the customer and the respective third-party provider.
In such cases, Motos & Wonders KLG is not the provider or lessor of the arranged third-party service. The content, availability, condition, suitability, insurance, deposit, deductible, handover, return, and proper performance of such third-party services shall be governed exclusively by the contractual terms and conditions of the respective third-party provider.
Claims arising from or in connection with such arranged third-party services must be asserted directly by the customer against the respective third-party provider.
In such cases, Motos & Wonders KLG shall only be liable for the proper arrangement of the service, but not for the performance of the arranged third-party service itself.
If a rental vehicle or other third-party service is not merely arranged but is expressly offered and confirmed as part of the tour service owed by Motos & Wonders KLG, such services shall be deemed part of the contractual scope.
12. Vehicles, Breakdown, Defect and Return Transport
Each participant is personally responsible for the technical condition, operational and road safety, legally required registration, insurance, and tour suitability of the vehicle used by them.
In the event of breakdown, defect, accident, damage, failure, or loss of the vehicle used by the customer, the customer shall in principle be personally responsible for towing, repair, replacement mobility, storage of the vehicle, return transport of the vehicle, and their own onward or return travel.
In such cases, Motos & Wonders KLG shall assist the participant, within reasonable limits, in organising suitable measures, in particular by helping with contact to breakdown services, workshops, rental companies, transport providers, accommodation providers, or insurers. Motos & Wonders KLG shall not be obliged to bear any costs in this respect unless the cause is attributable to a service owed by Motos & Wonders KLG or to conduct for which Motos & Wonders KLG is responsible.
Where rental vehicles, vehicle transport, or other vehicle-related services are merely arranged through third-party providers, the contractual terms, conditions of use, insurance provisions, and liability provisions of the respective third-party provider shall apply exclusively. Claims arising from or in connection with such services must be asserted directly against the respective third-party provider.
If a rental vehicle, vehicle transport, or other vehicle-related service is not merely arranged but is expressly offered and confirmed by Motos & Wonders KLG as part of the booked tour service, such service shall form part of the contractual scope.
13. Insurance
The arrangement and maintenance of legally required insurance cover, as well as insurance cover appropriate for the booked tour, shall be the responsibility of the participants. Motos & Wonders KLG does not provide any additional personal, vehicle, travel, accident, breakdown, casco, repatriation, or return travel insurance for participants unless expressly agreed otherwise in writing.
Each participant is personally responsible for ensuring that the vehicle used by them has all legally required insurance, registrations, and permits in place and valid for the entire duration of the tour.
If a rental vehicle is used, insurance cover, deductible, deposit, scope of cover, and claims handling shall be governed exclusively by the contractual and insurance terms of the respective rental company or third-party provider.
In the case of arranged transport services, in particular vehicle transport, insurance, liability, and claims handling shall be governed exclusively by the terms of the respective carrier or third-party provider.
Motos & Wonders KLG recommends obtaining appropriate insurance and assistance cover, in particular for:
third-party liability,
breakdown assistance,
tour interruption and return travel,
medical treatment costs and accident consequences,
and, depending on the tour model, vehicle damage, theft, return transport of the vehicle, and deductible risks relating to rental vehicles.
It shall be the sole responsibility of each participant to verify whether their existing insurance cover is sufficient for the booked tour, the vehicle used, the country of travel, and the intended use.
14. Defects, Remedy and Repatriation
Defects or complaints relating to the tour must be reported to Motos & Wonders KLG or the respective guide on site immediately after they become known. There is no strict written-form requirement for notices of defects.
Motos & Wonders KLG shall endeavour, within reasonable limits, to provide an appropriate remedy. This may in particular take the form of rectifying the defect, making a reasonable adjustment to the programme, providing an equivalent substitute service, or, where objectively justified, granting an appropriate price reduction.
If, due to a substantial defect or force majeure, an essential part of the booked tour cannot be provided in accordance with the contract and the tour is therefore terminated, Motos & Wonders KLG shall organise the objectively and organisationally appropriate repatriation of the participant within the framework of the applicable legal provisions.
Such repatriation relates exclusively to the participant as a person. The costs and organisation of towing, repair, storage, return transport, or repatriation of vehicles are not part of this obligation unless such service is expressly included in the booked tour service.
Any further claims shall exist only within the scope of the applicable legal provisions.
15. Data Protection and Image Rights
Motos & Wonders KLG processes personal data in the context of contract performance, operation of the tour, and customer communication in accordance with the applicable privacy policy.
Photos and videos may be taken during the tour for communication, documentation, and marketing purposes. Motos & Wonders KLG may use such recordings unless the persons concerned object either in advance or subsequently.
This applies in particular to group photos, atmosphere shots, and general tour impressions.
Where recordings particularly highlight, portray, or clearly individualise specific persons for marketing purposes, Motos & Wonders KLG shall generally obtain separate consent.
An objection to further use may be made at any time with effect for the future. However, publications or uses already made can only be reversed to the extent that this is reasonable and actually possible for Motos & Wonders KLG.
The current privacy policy of Motos & Wonders KLG shall also apply.
16. Entry, Transit and Compliance Notices
Each participant is personally responsible for ensuring that they fulfil all entry, transit, residence, driving, vehicle, insurance, and other legal requirements necessary for the booked tour and for the countries travelled to or crossed.
This applies in particular to:
valid identity and travel documents,
required visas or entry permits,
possession of valid driving licences,
legally required vehicle and insurance documents,
and compliance with customs, traffic, safety, and other official regulations.
Motos & Wonders KLG may, to the best of its knowledge, provide information on known general requirements relevant to the respective tour. However, verifying personal requirements and obtaining and maintaining the validity of all required documents and evidence remain the sole responsibility of the participant.
If a participant is unable to commence or continue the tour, or is unable to enter a country due to missing, invalid, or insufficient documents, permits, or legal requirements, this shall be deemed a circumstance for which the participant is responsible. In such case, there shall be no entitlement to a refund unless otherwise required by law.
Any additional costs, fines, charges, return travel, return transport, rebooking, or assistance costs arising from non-compliance with such requirements shall be borne by the respective participant.
17. Governing Law and Jurisdiction
Swiss law shall apply.
Mandatory statutory provisions, in particular mandatory consumer protection provisions applicable at the participant’s place of residence, shall remain reserved.
To the extent permitted by law, the registered office of Motos & Wonders KLG shall be the place of jurisdiction.
